Terms of Service
This is the agreement between you and NAHIM LLC (“Timalens”, “we”) covering the Timalens service. By creating an account or using the service you accept it. If you are accepting on behalf of an organisation, you confirm you may bind it.
The short version. You keep what you put in and what comes out. We keep the platform. AI output can be wrong — check it before you publish. Do not use Timalens for illegal content or for someone’s likeness without their permission. Either of us can end this at any time.
1. What the service does
Timalens turns a script or document into an animated whiteboard explainer video, using AI to plan the visuals, generate imagery, and synthesise narration. It is intended for instructional, training and explanatory content.
2. Eligibility
You must be at least 18 years old to use Timalens. By using it you confirm that you are, and that you are not barred from doing so under the laws that apply to you.
3. Your account
Sign-in is by one-time email code or Google. There is no password. Anyone with access to your inbox can therefore reach your account, so keep it secure. Tell us promptly at support@timalens.com if you believe your account has been used without your authority. You are responsible for activity under your account.
4. Who owns what
Your input
You keep all rights in the scripts, documents, prompts and other material you supply. You grant us a licence to host, process and transmit it, and to send it to the providers listed in our Privacy Policy, solely to operate the service and produce your video. That licence ends when you delete the content or close your account, save for backups pending their retention period.
Your output
Subject to your account being in good standing and fees being paid, you receive a perpetual, worldwide, irrevocable licence to use, modify, distribute and commercialise the videos you generate, including for commercial purposes, and that licence survives the end of this agreement. Free-tier output carries a Timalens watermark; removing it requires a paid plan.
AI models can produce similar output for different users from similar input. We therefore do not warrant that your output is unique, and we cannot promise it is copyrightable in your jurisdiction — the legal status of AI-generated works is unsettled in several countries, including the United States.
The platform
We keep all rights in Timalens itself: the software, models, interfaces, trade marks and everything else we provide. Nothing here transfers them to you.
5. Acceptable use
You must not use Timalens to create or distribute:
- anything illegal where you are, or where your audience is;
- material that harasses, defames, or incites hatred or violence against people or groups;
- sexual content involving minors, or any sexual content depicting a real person without their documented consent;
- a real person’s likeness, voice or identity without their permission, including impersonation and synthetic endorsements;
- content presented as fact that you know to be false, where it is likely to cause harm — medical, financial, electoral or otherwise;
- material infringing another’s copyright, trade mark or other rights;
- malware, or anything intended to disrupt systems or networks.
You must not resell or redistribute the service itself, attempt to extract or reverse-engineer the underlying models, evade usage limits, or use automated means to place load on the service beyond normal use.
We may suspend or terminate an account that breaches this section, and where content is unlawful we may remove it and report it.
6. Payment, credits and refunds
Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled. Prices and currencies are shown clearly before you purchase. Payments are processed securely via certified, encrypted third-party payment gateways supporting major credit and debit cards.
One credit equals one minute of rendered video. Plan credits are allocated each billing period. Purchased pay-as-you-go top-up credits do not expire while your account remains active.
Refunds. Credits consumed by a completed render are not refundable, because the compute has been spent. If a render fails through our fault, the credits are returned to your balance automatically. Unused subscription time is not refunded on cancellation; your plan simply runs to the end of the period already paid for. Statutory rights, including any EU or UK right to cancel, are unaffected.
If payment fails we may retry and will tell you. Access to paid features may be suspended while an account is in arrears; your content is not deleted for non-payment alone.
7. Availability and changes
We aim to keep Timalens available but do not guarantee uninterrupted service. We may change or discontinue features. If we discontinue the service entirely we will give at least 30 days’ notice so you can export your work.
8. AI output — no warranty of accuracy
Timalens output is generated automatically and is not reviewed by a human before you receive it. It may be inaccurate, incomplete, biased or misleading. You are responsible for reviewing it before you rely on it or publish it — particularly for training, compliance, medical, legal or financial material.
To the fullest extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.
9. Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused.
Our total aggregate liability arising out of or relating to this agreement is limited to the total fees you paid us in the 12 months before the event giving rise to the claim. If you have paid us nothing, our liability is limited to USD 100.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
10. Indemnification
You will indemnify and hold harmless NAHIM LLC and its officers and employees against claims, damages and reasonable legal costs arising from the content you supply or generate, your use of the service, or your breach of these terms — including claims that your content infringes a third party’s rights. We will notify you of any such claim and you may control the defence, provided any settlement releases us fully.
11. Termination
You may close your account at any time from settings or by writing to us. We may suspend or terminate your account for breach of these terms, for unlawful use, or on 30 days’ notice for any other reason.
On termination your right to use the service ends. Your account and content are deleted within 30 days, except payment records we must keep for tax and accounting purposes. Export anything you want to keep before closing your account — rendered videos are removed 7 days after generation in any case. The licence to output you generated while the account was in good standing survives.
12. Governing law and disputes
These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico, and waive any objection to that venue.
Class action waiver. To the fullest extent the law allows, claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding.
If you are a consumer resident in the EU or UK, this section does not deprive you of the protection of mandatory provisions of your local law, nor of the right to bring proceedings in your local courts.
13. Changes to these terms
We may update these terms. For material changes we will give 30 days’ notice by email before they take effect. Continuing to use Timalens after that means you accept them; if you do not, close your account before they take effect.
14. General
If a provision is held unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it as part of a merger or sale of assets. These terms and the Privacy Policy are the entire agreement between us on this subject.
